The websites www.chateaux-france,com, www.chateaux-france.app and all their derivatives:

– its cardinal sites, by adding one or more alphanumeric characters in place of “www”,

– sites that are translations thereof, such as: chateaux-france.fr, frankrijk-kastelen.com, schlosser-frankreich.com, castelli-francia.com, (it being specified that this list is neither restrictive nor exhaustive),

Collectively referred to as “the Site” or “the Publisher”.

The purpose of the present terms and conditions is to provide a legal framework for the provision of the Wallet by SAS ECS (hereinafter referred to as “The Company” or “ECS“), on the one hand,

And to define the conditions of access and use of these services detailed below to any User Member of the site, Sellers and Buyers, within the meaning of Article IV of our General Terms and Conditions, hereinafter referred to as “the Member” or “the Members“, on the other hand.
The Members accept these special terms and conditions and declares that they have a sufficient understanding of the language, in its original version, French, which always prevails over the translated versions of these terms and conditions.

In consideration of access to, consultation and use of the services detailed herein, the Member agrees to respect and comply with these Conditions as defined below.

The company reserves the right to unilaterally modify the content of these Conditions at any time.

Article Preliminary: Legal notices

The Site is published by SAS ECS – Eden & Chateaux Stream. 3bis, rue Albert Einstein 93200 Saint-Denis – France, registered with the Trade and Companies Register under number PARIS 899 268 718, Tel.: +33 1.47.55.17.02 – email, Intra-Community VAT number FR68899268718, hereinafter referred to as “SAS ECS”.

When used in these terms and conditions, the terms “Chateaux-France,” “we,” “us,” or “our” refer to SAS ECS, with whom the Members are entering into a contract.

As part of using the Site, the Member benefits from an electronic wallet (hereinafter the “Wallet”), set up by Chateaux-France.

This wallet is designed to receive electronic money.

The Wallet operates in accordance with our General Terms and Conditions of Sale and these provisions, as well as the terms of use agreed between the Member and the banking service provider of SAS ECS.

Article 1 : Wallet Functions

The Wallet’s function is to allow the Seller Member, on the one hand, to receive payment by bank transfer for their sales and reservations recorded in the credit.

The Wallet’s function is to allow the Purchasing Member to receive payment by bank transfer of any refunds recorded in the credit.

The Wallet also allows Seller and Buyer members to make purchases on the Site using the funds available in the Wallet they have opened.

The Wallet can be credited:
– by Credit Card
– by bank transfer
– by crediting amounts due as refunds.
– by the net proceeds of Commissions from sales and reservations made by the Member on the Site.

Article 2 : How the Wallet Works

The Seller expressly waives any claim to the benefit of sums (interest or other) that may be produced by the immobilization of amounts received or credited to the Wallet.

The Wallet operates under the Member’s responsibility and the fact that Chateaux-France allows the Member to benefit from this service within the framework of the use of the Site does not create any obligations of means or result on the part of Chateaux-France other than those resulting from the operation of the Site.

Article 3 : Chateaux-France Mandate

Chateaux-France is authorized to instruct the banking institution where the account is opened to carry out, in view of the transactions carried out by the Member, to the operations relating the use of the Wallet.

Article 4 : Supply, Wallet funding

The Wallet can only allow a purchase transaction if it is sufficiently funded when the transaction is carried out.

The Wallet cannot function if its balance is negative or if the credited sums are insufficient to cover the intended purchase and it is the Member’s responsibility to ensure, before placing an order, by checking on the Site, the availability of funds.

Article 5 : Wallet Usage Limitations

The funds available in the Wallet can only be used by the Member for:

  • To make purchases on the Site, in accordance with the General Terms and Conditions of Use,
  • To receive the funds listed therein via bank transfer.

The Member therefore authorizes Chateaux-France to carry out on the Wallet opened in his name and within the limit of the sums available on it all debit or credit operations generated by his use of the Site.

Article 6 : Supply times

It is recalled here that when the sum to be credited to the Wallet comes from the price of a sale made by the Member, there is a payment delay between the completion of the sale and the availability of the corresponding funds.

This payment period is in accordance with the General Terms and Conditions of Use.

Similarly, the time it takes to credit the Wallet with funds from a transfer will depend on the usual existing collection times.

During these delays, the Member cannot carry out any purchase transactions by debiting the sums pending credit.

Article 7 : Transactions recorded in the Wallet account

As purchases or sales are made, and subject to the payment deadlines described above, the Member’s Wallet account records these transactions.

It is noted that the Member can consult the status of his Wallet account at any time and that Chateaux-France is not obliged to send the Member written statements relating to the status of the Wallet opened in his name.

Article 8 : Trusted third party

The Member authorizes Chateaux-France to entrust the management of certain technical or operational aspects of the Wallet to a trusted third party. The Member therefore authorizes Chateaux-France to share their personal data with said trusted third party, in strict compliance with regulations.

Article 9 : Fees

The Wallet is subject to a technical maintenance fee of five (5) euros every twelve (12) months from its activation date. The Member authorizes Chateaux-France to automatically debit or have this amount debited directly from their debited Wallet up to the available funds, without the debit resulting in a debit balance.

Article 10 : Transfer – assignment

The Member authorizes Chateaux-France to assign its rights and obligations arising from this agreement to any company within the ECS Group. If applicable, the Member will be informed in advance of any contract assignment.

Article 11 : Locking & Suspension

In the event of a dispute and until the dispute is resolved, the Member’s use of the Wallet may be temporarily blocked by Chateaux-France.

For serious reasons (serious breach or repeated breaches of the General Terms of Use, sale of Prohibited Products, etc.), Chateaux-France has the right to suspend any access to or use of the funds available on the Wallet.

This suspension of access or use will remain in effect until this dispute is resolved.
