– its cardinal sites, by adding one or more alphanumeric characters in place of “www”,

– sites that are translations thereof, such as: chateaux-france.fr, frankrijk-kastelen.com, schlosser-frankreich.com, castelli-francia.com, (it being specified that this list is neither restrictive nor exhaustive),

Collectively referred to as “the Site” or “the Publisher”.

I – WARNINGS – Authorization procedures

The information (models, texts, images, photographs and visuals, data) contained in the Chateaux-France.com and Chateaux-France.app Websites (as well as all their derivatives: cardinal sites, by the addition of one or more alphanumeric characters in place of “www”, sites that are translations thereof, such as: chateaux-france.fr, frankrijk-kastelen.com, schlosser-frankreich.com, castelli-francia.com, it being specified that this list is neither restrictive nor exhaustive) are the property of SAS ECS, jointly with its assignees.

They are subject to copyright, trademark and industrial property laws.

Consequently, any reproduction, even partial, without the express authorization of ECS will give rise to legal proceedings.

Any reproduction of all or part of the Chateaux-France.com website may only be made with the express written and personal authorization of SAS ECS.

II – WARNING concerning any infringement of database protection

SAS ECS reminds you that it is the author and producer of the databases displayed on this Site.

In addition, it points out that the French Intellectual Property Code provides legal protection for the author of databases:

article L. 341-1: “the producer of a database, understood as the person who takes the initiative and the risk of the corresponding investments, benefits from a protection of the contents of the database when the constitution, verification or presentation of the latter attests to a substantial financial, material or human investment;

this protection is independent of and without prejudice to those resulting from copyright or any other right in the database or one of its constituent elements”;

article L. 342-1: “the database producer has the right to prohibit :

1 ) extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the contents of a database to another medium, by any means and in any form whatsoever;

2 ) reuse, by making available to the public all or a qualitatively or quantitatively substantial part of the contents of the database, in whatever form;

these rights may be transferred, assigned or licensed;

public lending is not an act of extraction or reuse”;

article L. 342-2: “the producer may also prohibit the repeated and systematic extraction or reuse of qualitatively or quantitatively insubstantial parts of the contents of the database when such operations manifestly exceed the conditions of normal use of the database”;

article L. 343-1 as it stood at the time of the offence (wording resulting from the law of July 1, 1998, the law of March 9, 2004 having not modified the offence but increased the penalties and added the aggravating circumstance of organized gang): “infringement of the rights of the producer of a database as defined in article L. 342-1 is punishable by two years’ imprisonment and a fine of 1,000,000 francs (150,000 euros)”;

As the producer of the database used to publish the Chateaux-France.com website, as well as all the websites derived from it, the French company SAS ECS strictly prohibits any extraction by transfer of the content of the said database to another medium or by reuse by making available to the public all or a qualitatively or quantitatively substantial part of the content of the database, in any form whatsoever.

III – Overall Contract, as a whole

The Site applies other conditions in addition to these Legal Notices – Copyrights, such as the T&CU (General Terms and Condition of Use), which describe its Terms of Use, the Privacy and Security Policy (SPP, in French “PSC”), which describes the collection and use of personal data and other additional conditions, linked to these Conditions apply to any use of the Site.

They are incorporated by reference, and form an integral part of the contractual package (hereinafter referred to as the “Contract“).

The invalidity of one or more of the clauses herein shall not render the Contract null and void.

IV – Applicable law and jurisdiction

French law applies to this Agreement.
In the event of failure to reach an amicable resolution of a dispute between the parties, the French courts within the jurisdiction of the Paris Court of Appeal—Paris France being the place of performance and rights referred to herein—shall have sole jurisdiction to hear the case.
