The websites www.chateaux-france,com, www.chateaux-france.app and all their derivatives:

– its cardinal sites, by adding one or more alphanumeric characters in place of “www”,

– sites that are translations thereof, such as: chateaux-france.fr, frankrijk-kastelen.com, schlosser-frankreich.com, castelli-francia.com, (it being specified that this list is neither restrictive nor exhaustive),

Collectively referred to as “the Site” or “the Publisher”.

Preamble

These General Terms of Service of Sale (the “Terms”) are a legally binding contract between you and the Site that governs your right to use websites, applications, and other offerings developed by the Site (collectively, the “Chateaux-France Platform”).
The The User (as defined in the T&CU) accepts the terms and conditions and declares that they have a sufficient understanding of the language, in its original version, French, which always prevails over the translated versions of the terms and conditions.

When used in these terms and conditions, the terms “Chateaux-France,” “we,” “us,” or “our” refer to SAS ECS, with whom you are entering into a contract.

I – Advertisement service

The Site’s online advertising service is published and developed by SAS ECS.

It enables relationships to be formed or connections (“Connections”) It enables registered users who wish to make reservations for tours, stays, events, as well as purchases of products and any related services (these offers are hereinafter referred to as the ”Services”).

When the Users purchase or make reservations on a regular basis as part of a professional activity, French consumer protection laws do not apply and common French law governing sales between professionals takes precedence.

These Users, private individuals and professionals, are registered on the Site and are collectively referred to below as “Buyers” or “Customers”.

The Website allows Buyers to connect with other users registered on the Website. These latter users have previously submitted offers concerning the Services they provide within or in connection with a place for which they are qualified to exclusively promote and solicit offers, as owners, agents, delegates (or any other valid capacity). They are deemed to offer the services and products presented to the public on a regular basis. As such, they act in a professional capacity. They are collectively referred to below as “Sellers” or “Service Providers”.

II – Independence of Members

Sellers and Buyers are hereinafter jointly referred to as “Members”. The Site enables the conclusion of sales contracts between sellers and buyers.

Members are solely responsible for deciding whether to proceed with the reservation, booking, purchase, or sale.

III – Mandate GIVEN by Members TO the site

Acceptance of these General Terms and Conditions of Sale (GTCS) of the Website by Members constitutes a mandate given to SAS ECS to connect Sellers and Buyers and to carry out transactions on the Website in accordance with the terms and conditions set out below.

IV – Membership Quality – Mandate Limit

The Site offers online tools that allow seller users to publish, offer, promote, or sell, and buyer users to search for and reserve services or products.
Sellers publish and offer services or products to Buyers who search for, reserve, order, or use these services or products.

The Services offered may be accommodations (“Accommodations”), activities, tours, and venue rentals for events (“Expériences”), travel services for stays and other services, as well as manufactured or consumer goods and food (collectively referred to as the “Provider Services” or “Service” and each Provider Service offering, an “Advertisement”).

As the provider of the Site, SAS ECS does not own, control, offer, or manage any advertisements, Service Provider Services, or any tourism services. SAS ECS is not a party to contracts concluded directly between Service Providers and Customers, and SAS ECS is not a real estate agent, travel agency, insurer, or organizer or retailer of package tours under Directive (EU) 2015/2302. Within the strict limits of the referral mandate defined in the previous article, the Site does not act as an agent for any Member. Chateaux-France is also not a manufacturer, distributor, or seller of the goods and products offered by its members on the Site.

V – Updates

SAS ECS reserves the right to amend these General Terms and Conditions of Sales and undertakes to inform Members of any changes or additions on its website, in particular by displaying the date of the last update at the top of these GTCS.

VI – Overall Contract, as a whole

The Site applies other Terms and Conditions in addition to these GTCS, such as the General Terms and Conditions of Use (“T&CU”) that describe its use, the Security and Privacy Policy (SPP or, in French : “PSC”), which describes the collection and use of personal data, Copyrights, and other conditions that apply to Member Users.
These additional terms and conditions are linked to these Terms and Conditions, which apply to any use of the Site.
They are incorporated by reference and form an integral part of the contractual agreement (hereinafter referred to as the “Agreement“).

The invalidity of one or more clauses herein shall not invalidate the Agreement.
The invalidity of one or more clauses of the contractual agreement shall not invalidate these T&CU.

VII – Applicable law and jurisdiction

French law applies to this Agreement.
In the event of failure to reach an amicable resolution of a dispute between the parties, the French courts within the jurisdiction of the Paris Court of Appeal—Paris being the place of performance and rights referred to herein—shall have sole jurisdiction to hear the case.
