Collectively referred to as “the Site” or “the Publisher”.

The purpose of these General Terms and Conditions of Use (hereinafter referred to as “T&CU”) is to provide a legal framework for the terms and conditions governing the provision of the Website,

as well as the services set up by SAS ECS (hereinafter referred to as “the Company” or “ECS”), which is the publisher, on the one hand,

and to define the conditions of access and use of the services by any user of the site, hereinafter referred to as “the User” on the other hand.

The User accepts the terms and conditions and declares that they have a sufficient understanding of the language, in its original version, French, which always prevails over the translated versions of the terms and conditions.

In return for access to, consultation and use of the Site, the User undertakes to respect and comply with these Terms of Use (“T&CU”) as defined below.

Any registration or use of the site implies the User’s unreserved and unrestricted acceptance of these T&CU. When registering on the site via the Registration Form, each user expressly accepts these T&CU by checking the box preceding the following text: “I acknowledge that I have read and understood the T&CU and I accept them.”

If the User does not accept these T&CU, they must refrain from using the services offered by the website.

The Company reserves the right to unilaterally modify the content of these T&CU at any time.

Article 2: Access to the site

The Site provides the User with access to the following services:

The website and the e-commerce services it offers.

The site is accessible anywhere to any User with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at their expense.

Non-member Users do not have access to the reserved services. To do so, they must register by filling out a form. By agreeing to register for the reserved services, the User becomes a member and undertakes to provide truthful and accurate information concerning their civil status and contact details, in particular their email address.

To access the services, the User must then log in using their username and password, which will be provided after registration.

Any regularly registered member User may also request to unsubscribe by going to the dedicated page in their personal space. This will take effect within a reasonable period of time.

ECS endeavors to keep the Site accessible, without being under any obligation to do so. It is specified that access to the Site may be interrupted for maintenance, updates, and other reasons, particularly technical reasons beyond ECS’s control, such as telephone network outages, Site overload, or failures of any kind. ECS is therefore in no way responsible for these interruptions and the consequences that may result for the User.
Furthermore, ECS cannot be held liable for any damage resulting from viruses, fraudulent intrusion by a third party leading to a modification of the said data, bugs, in any form whatsoever, any program or application that is incompatible with the hardware or software used by the User, or for any damage suffered by the User as a result of negligence or fault on their part or on the part of any third party.

ECS makes every effort to update the content of the Site and to provide Users with accurate, precise, and complete information. However, some of the information on the Site may be outdated or inaccurate.
Indeed the site consists of offers and advertisements made by its members to Users.

Furthermore, ECS has no means or action available to it to verify the accuracy of the information published by its members.

ECS will therefore make every effort, to the extent that Users can reasonably expect from Providers, to correct any inaccuracies.

Article 3: Data collection

In accordance with Article 30 of the GDPR, the automated processing of personal information on the Site has been expressly recorded in the Data Processing register kept by the Company.
ECS will collect personal data concerning the Customer, in particular when Product orders are placed.
Certain information requested from the Customer when placing an order is mandatory in order to validate the order.
The Customer is expressly informed and authorizes that their contact details may be transmitted to third parties for the purposes of processing the order or performing the service.
Furthermore, the information requested is processed electronically by ECS for the purposes of managing its customer database, statistical analysis, and commercial prospecting. It may be transmitted to third parties for the same purposes.
Consequently, unless the Customer objects, ECS may send information by email, particularly in the form of newsletters, to help the Customer better understand and use the website and the offers available.
In accordance with the French Data Protection Act of January 6, 1978, the Customer has the right to access, rectify, modify, and delete data concerning him/her. He/she may exercise this right by sending:

The Site and each of its components (such as trademarks, logos, texts, structure, features, databases, etc.) are the exclusive property of their rights holders, who are solely authorized to use the intellectual property rights.

By accessing the Site, the User is therefore granted a non-exclusive license for private use only, strictly limited to the content of the Site.
It follows that the reproduction of any documents published on the Site is only authorized for the exclusive purposes of information and for strictly personal and private use.

The User shall ensure that their password remains secret. Any disclosure of the password, in any form whatsoever, is prohibited. The User assumes the risks associated with the use of their username and password. The Site declines all responsibility.

The Site cannot be held liable for any viruses that may infect the Internet user’s computer or any computer equipment following use of, access to, or downloading from this site.

The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable actions of a third party.

They are incorporated by reference and form an integral part of the contractual agreement (hereinafter referred to as the “Agreement”).

The invalidity of one or more clauses herein shall not invalidate the Agreement.
The invalidity of one or more clauses of the contractual agreement shall not invalidate these T&CU.

Article 9: Applicable law and jurisdiction

French law applies to this Agreement.
In the event of failure to reach an amicable resolution of a dispute between the parties, the French courts within the jurisdiction of the Paris Court of Appeal—Paris being the place of performance and rights referred to herein—shall have sole jurisdiction to hear the case.
