\u201c<strong>Terms<\/strong>\u201d) apply to member users as defined in <a href=\"https:\/\/www.chateaux-france.app\/en\/cgu-tcu\/\">Article 2, paragraph 4 of our General Terms and Conditions of Use<\/a>, hereinafter referred to as \u201c<strong>You<\/strong>\u201d, \u201c<strong>Your<\/strong>\u201d or \u201c<strong>yours<\/strong>\u201d, and constitute a legally binding agreement between you and Chateaux-France governing your right to use the Site. When used in these Terms, the terms \u201c<strong>Chateaux-France<\/strong>\u201d, \u201c<strong>we<\/strong>\u201d, \u201c<strong>us<\/strong>\u201d or \u201c<strong>our<\/strong>\u201d refer to SAS ECS, mentioned below, with which you are entering into a contract.<br>You accept these special terms and conditions and declares that you have a sufficient understanding of the language, in its original version, French, which always prevails over the translated versions of these terms and conditions. <\/p><p>The Chateaux-France online ad service is published and hosted by ECS &#8211; Eden &amp; Chateaux Stream (&#8220;<strong>ECS<\/strong>&#8220;), a simplified joint stock company with capital of 4,000 euros, headquartered at 3bis, rue Albert Einstein 93200 Saint-Denis &#8211; France &#8211; France, registered with the Registre du Commerce et des Soci\u00e9t\u00e9s under number 899 268 718, Tel. +33 1.47.55.17.02 (not surcharged) &#8211; e-mail, VAT number FR68899268718. <\/p><p>In accordance with our <a href=\"https:\/\/www.chateaux-france.app\/en\/gtcs-2\/\">General Terms and Conditions<\/a>: the Site offers an online tool enabling connections (\u201c<strong>Connecting<\/strong>\u201d) between buyer members (\u201c<strong>Buyers<\/strong>\u201d or \u201c<strong>Clients<\/strong>\u201d) and seller members (\u201c<strong>Sellers<\/strong>\u201d or \u201c<strong>Providers<\/strong>\u201d) for the purpose of making reservations for visits, stays, events, and any related ancillary services. Sellers and Buyers are hereinafter jointly referred to as \u201c<strong>Members<\/strong>.\u201d The Site facilitates the conclusion of sales and reservation contracts between Site members: Sellers and Buyers, pursuant to the mandate given in accordance with <a href=\"https:\/\/www.chateaux-france.app\/en\/gtcs-2\/\">Articles III and following of our General Terms and Conditions<\/a>.  <\/p><p>It is reminded that Members are the sole decision-makers regarding the completion of the reservation, purchase and sale.<\/p><p>Providers offer accommodation (\u201c<strong>Accommodation<\/strong>\u201d), activities, tours and events (\u201c<strong>Experiences<\/strong>\u201d), as well as travel services for stays and other things (collectively: the \u201c<strong>Provider Services<\/strong>\u201d, or \u201c<strong>Services<\/strong>\u201d) and each offer of Provider Service, an \u201c<strong>Advertisement<\/strong>\u201d.<\/p><p>Consequently, Chateaux-France presents different categories of Ads:<\/p><p>\u2013 stays (the \u201c<strong>Stays<\/strong>\u201d or \u201cAccommodations\u201d),<\/p><p>\u2013 self-guided or guided tours of the places, either indoors or outdoors (the \u201c<strong>Tours<\/strong>\u201d),<\/p><p>\u2013 rental of establishments (places or venues) to organize private events, such as receptions, birthdays, weddings, product launches, seminars and others (the \u201c<strong>Events<\/strong>\u201d).<\/p><p>Service providers are deemed offer as a matter of course services to the public in establishments that they control, manage, or own. This includes: buildings, furnishings, installations, and all objects (decorative or service-related) attached thereto (hereinafter referred to as: the \u201c<strong>Establishments<\/strong>\u201d or the \u201c<strong>Establishment<\/strong>\u201d). <\/p><p>In this capacity, they act in a professional capacity, in accordance with our <a href=\"https:\/\/www.chateaux-france.app\/en\/gtcs-subscribers\/\">GTC General Terms and Conditions of Sale for Subscribers Members<\/a>.<\/p><h2>SERVICE PROVIDERS&#8217; GUARANTEE AGAINST DAMAGES<\/h2><p>The Provider Damage Guarantee reimburses you up to \u20ac500 in the rare event that your property is damaged by a client during a service booked with Chateaux-France.<br>You may be eligible for reimbursement for certain types of damage to your property if the responsible client does not compensate you.<\/p><h3>What is covered<\/h3><p><strong>The Provider Damage Guarantee covers you in the event of:<\/strong><br>&#8211; Damage caused by customers to your establishment and its furnishings.<br>&#8211; Damage caused by customers to parked cars, boats, or other vehicles.<br>&#8211; Additional cleaning costs to remove stains left by customers (or their guests), to remedy damage caused by pets, and to eliminate smoke odors.<\/p><p><strong>The Provider&#8217;s Damage Guarantee does not cover you in the event of:<\/strong><br>&#8211; Damage due to normal wear and tear<br>&#8211; Exchange rate loss<br>&#8211; Loss due to natural disasters (such as earthquakes and hurricanes)<br>&#8211; Bodily injury or property damage suffered by travelers or third parties (this may be covered by the Host&#8217;s Liability Insurance)<br>&#8211; Cleaning associated with normal check-out tasks (laundry, dishes, or garbage removal, for example)<br>&#8211; Beyond the limit of \u20ac500 per dispute\/damage claim<br>&#8211; If the Client refuses to pay or does not respond<br>&#8211; Other limitations apply<\/p><h2>The refund process<\/h2><p>Here&#8217;s how to get a refund for damages incurred during a service:<br>Gather evidence of the damage by taking photos or videos, or by obtaining a quote\/receipt for repair or cleaning costs.<br>Within 14 days of the responsible guest&#8217;s departure, submit a refund request to the Resolution Center.<br>The Chateaux-France support team will then review the request.<\/p><p>Your customer has 24 hours to respond to the request. If they do not respond, pay only part of the requested amount, or refuse to pay, you cannot submit a claim under the Damage Guarantee.<br>You can only submit a claim if the customer has responded and agreed to credit their Wallet with the agreed amount. <\/p><h2>Cleaning fees and pet fees<\/h2><p>If you choose to include cleaning or pet fees, keep in mind that these are only intended to cover anticipated expenses. The Provider Damage Guarantee, on the other hand, covers unforeseen expenses related to additional cleaning fees or damage caused by animals (for example, removing smoke odors or replacing a sofa damaged by a dog).<\/p><h2>Warnings<\/h2><p>The Provider Damage Guarantee is not an insurance policy. It does not cover Providers beyond a limit of \u20ac500.<br>Please note that all coverage limits are displayed in Euros. <\/p><p>The Provider Damage Guarantee is not linked to the Host&#8217;s Liability Insurance.
